Short-Term Rental (Vacation Rentals) Ordinance

 

The City of Hayden Lake's City Council passed rules and regulations related to short-term stays in residential structures, sometimes referred to as Short-Term Rentals (STR) on October 20, 2020.


Short-Term (Vacation) Rental Permit Fees:

  • Annual Fee: $300


TIMELINE:

The City of Hayden Lake is accepting permits online at this time. Code Enforcement will be actively searching for properties that are operating without a permit. The city will process and issue permits in the order received.

 

PRIOR TO FILLING OUT THE APPLICATION:

  1. Review the supporting documents and the copy of the Short-Term-Rental ordinance below.
  2. After reviewing the documents, complete the Short-Term Rental Application and submit it with the Neighbor Notices, Parking Plan, and Fire Plan.

 

PLEASE NOTE!

The following is a list of items that will need your attention to successfully apply for a short-term rental permit. The following items are provided because they require additional information. Please note that this is not an exhaustive list. This list is provided for your convenience to help you prepare.

 

ITEMS NEEDED FOR SUCCESSFUL APPLICATION:

These are supporting documents that the city will need a copy of, in addition to your application. 

  • Parking Plan:

    • Number/location of stalls
    • Show Street/Avenue/Road (and provide address)
  • Safety Sheet for each floor showing:
    • Escape plan - Including listing the location of all rooms, doors, and windows
    • Gas, water, electrical shut offs where applicable
    • Emergency contact number (not 9-1-1)


Supporting information to get ready for input into the online application (not all-inclusive):

  • Contact information
    • Owner (Name, Address, Email, and Phone)
    • Responsible Party (Name, Address, Email, and Phone - if applicable)
  • Emergency phone number
  • Neighborhood Notices:
    • Name/address/date of notice provided (for each)
  • That you have installed smoke and carbon monoxide detectors where needed
  • 2-A-10-BC Fire extinguishers on each floor (tested)
    • Date of fire extinguisher inspection (Month/Year)
  • Address numbers facing the street (4” tall & ½” stroke minimum)
  • Additionally, if the unit is part of a structure that has a fire sprinkler suppression system, you will need to provide the date of the last inspection. This is typical of multi-family/condo buildings.

Short-Term Rental regulations at a glance:

  • Ordinance legalizes short-term (vacation) rentals in the City of Hayden Lake and is consistent with HB 216 (signed by the Governor on April 4, 2017 and effective January 1, 2018)
  • Short-term rentals will need to apply for a permit with the City annually (unless they are exempt as noted below)
  • Sets a standard for threshold when permitting is required by owner/responsible party
    • From 1 night up to 29
    • 30+ days is month to month- considered a typical rental
    • Exemption for short-term rental of unit/bedroom:
    • No more than 14 days per calendar year – may be divided into 2 stays
  • All permitted STRs will need to post their permit number on all advertisements
  • Permits will not be transferrable from owner to owner or property to property
  • Application/Self-inspection Checklist must be completed
  • Requires an owner or responsible party to be available 24/7 while unit is occupied
  • Provides 60-minute window for resolution of issue to prevent Police calls/trips to STR
  • Requires posting of emergency contact numbers and emergency exit route inside the STR
  • Requires certain information be provided to renters (copy of permit, safety plan, contact info for responsible parties, Good Neighbor Policy, trash days, etc.)
  • Regulates occupancy just like any other residential property
  • Prohibits outdoor storage and signs
  • Regulates parking - a parking plan must be provided to the City and renters
  • Requires use of trash containers
  • Requires notice be provided to adjacent neighbors (See “Neighbor Notice” link above).
